Acceptable Use Policy (AUP) for TopChat.bot
1. Overview
This Acceptable Use Policy (“AUP”) governs your use of TopChat.bot (“Company,” “we,” “us,” or “our”) and its services (the “Services”).
By using the Services, you agree to comply with this AUP.
This policy is designed to ensure that the platform is used:
- Legally
- Ethically
- Without harm to others or the platform
We reserve the right to suspend or terminate accounts that violate this AUP.
2. Prohibited Activities
You may NOT use the Services to engage in any of the following:
2.1 Spam and Unsolicited Communications
- Sending messages to users without proper consent
- Sending bulk or mass messaging campaigns to unverified contacts
- Using purchased, scraped, or third-party contact lists
Example violations:
- Uploading a CSV of leads from the internet and blasting messages
- Messaging users who never opted in
2.2 Fraud, Deception, and Misrepresentation
- Phishing or attempting to collect sensitive information
- Misleading users about your identity or intent
- Promoting scams, fake offers, or deceptive services
Example violations:
- “You’ve won a prize, click here” scams
- Pretending to be a bank, government entity, or brand
2.3 Impersonation and Misuse of Identity
- Impersonating individuals, businesses, or organizations
- Creating bots that falsely represent real people
Example violations:
- A chatbot pretending to be a real support agent when it is not disclosed
- Using another company’s brand without authorization
2.4 Harassment and Harmful Content
- Sending abusive, threatening, or harassing messages
- Promoting hate, violence, or discrimination
2.5 Illegal Activities
- Using the platform for unlawful purposes
- Violating applicable regulations (privacy, marketing, consumer protection laws)
3. Messaging and Contact Compliance
You are solely responsible for ensuring that your messaging activities comply with all applicable laws, including:
- TCPA (Telephone Consumer Protection Act)
- CAN-SPAM Act
- GDPR or similar regulations (if applicable)
You must:
- Obtain clear and verifiable consent before messaging users
- Provide an opt-out or unsubscribe mechanism
- Honor opt-out requests promptly
Example violations:
- Messaging users who never opted in
- Ignoring unsubscribe requests
- Sending repeated messages after opt-out
4. AI and Automation Usage
You agree NOT to use the platform’s AI or automation features to:
- Generate misleading, deceptive, or harmful content
- Create bots that intentionally mislead users
- Conduct large-scale automated abuse campaigns
Transparency Requirement
Where required by law or platform policies, you must clearly disclose when users are interacting with a bot.
Example violations:
- A bot pretending to be a human sales rep without disclosure
- AI-generated messages used to manipulate or deceive users
5. Platform Abuse and Technical Misuse
You may NOT:
- Overload or disrupt the platform infrastructure
- Attempt to bypass usage limits or restrictions
- Reverse engineer, copy, or exploit the system
- Use automation to abuse system resources
6. Third-Party Platform Compliance (Meta, WhatsApp, etc.)
If you use TopChat.bot with third-party platforms (e.g., Meta, WhatsApp, Messenger), you must comply with their policies.
Violations of third-party policies may result in immediate suspension of your account.
Common Meta / WhatsApp Policy Violations
The following are frequent causes of account bans on messaging platforms:
6.1 Messaging Without Consent
- Sending messages to users who did not opt in
6.2 High Block or Report Rates
- Users frequently blocking or reporting your messages
6.3 Low-Quality or Irrelevant Messaging
- Sending spammy, repetitive, or irrelevant content
6.4 Misleading or Deceptive Content
- Clickbait, fake offers, or dishonest messaging
6.5 Prohibited Content Categories
- Scams, illegal products, or regulated content without compliance
6.6 Template Abuse (WhatsApp-specific)
- Reusing templates in spam-like ways
- Sending promotional messages disguised as transactional
Real-world example:
- Sending a “service update” message that is actually a promotion → can trigger WhatsApp bans
7. Data Collection and Privacy Violations
You may NOT:
- Collect personal data without proper consent
- Store or process sensitive data unlawfully
- Use the platform to harvest or scrape user information
8. Enforcement and Actions
We reserve the right to take action at our sole discretion, including:
- Warning the user
- Suspending account access
- Permanently terminating accounts
- Deleting associated data
- Reporting violations to relevant authorities or third parties
We may take action without prior notice, especially in cases involving:
- Legal risk
- Platform abuse
- Third-party policy violations
9. No Liability for Enforcement Actions
We are not liable for any losses resulting from:
- Account suspension or termination
- Loss of data
- Third-party bans (e.g., Meta, WhatsApp)
10. Updates to this Policy
We may update this AUP at any time.
Continued use of the Services constitutes acceptance of the updated policy.
